Terms of Service

By accessing or using Next Gen Reservations, you agree to these Terms of Service. If you do not agree, please do not use the service.

Next Gen Reservations provides software for restaurant reservations, restaurant locations and related operational functionality. Features available to you are those actually released in the product at the time of use.

If you create a restaurant workspace, you represent that you are authorized to act on behalf of that restaurant or organization and to accept these Terms for it.

You are responsible for maintaining the security of your credentials and for the staff accounts you authorize to access your workspace. Notify us promptly if you believe an account has been compromised.

Restaurants are responsible for:

• Accuracy of business information
• Reservation policies
• Customer communications
• Lawful use of guest information
• Staff authorized to access the account

Restaurants are responsible for their relationship with their guests and for the lawful use of guest and reservation information. Next Gen Reservations provides the technology that facilitates that relationship.

You agree not to use the service for:

• Unlawful activity
• Unauthorized access to accounts or data
• Attempting to bypass security controls
• Scraping or extracting data belonging to other tenants
• Interfering with or disrupting the platform
• Impersonation of any person or business
• Distributing malicious software
• Abusing, overloading or attacking the service

You may only access organizations, restaurants, locations and data for which you have authorization. Any attempt to reach another tenant's data is a material violation of these Terms.

We make reasonable efforts to keep the service available and reliable, but uninterrupted or error-free availability is not guaranteed. Maintenance, updates and factors outside our control may affect availability.

The service is actively developed. Features may evolve, improve or change over time as the product develops.

Optional services such as Google authentication or location services are provided by third parties and may be governed by those parties' own terms and privacy policies.

The Next Gen Reservations software, branding, design and platform technology are owned by or licensed to Next Gen Profits LLC.

Restaurant customers retain ownership and control of their own restaurant content and data, subject to the rights necessary for us to operate and provide the service.

If you voluntarily provide product feedback, Next Gen Profits LLC may use it to improve the service without any transfer of ownership of your restaurant data.

Access may be suspended or terminated in response to security threats, illegal activity, abuse, material violations of these Terms or other legitimate operational reasons.

The service is provided "as is" and "as available," without warranties of any kind to the extent permitted by applicable law, including implied warranties of merchantability, fitness for a particular purpose and non-infringement.

To the maximum extent permitted by applicable law, Next Gen Profits LLC will not be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, lost revenue or lost data arising from the use of or inability to use the service.

You agree to defend and indemnify Next Gen Profits LLC against claims, damages and reasonable costs arising from your use of the service, your content, or your violation of these Terms or applicable law.

Billing is not currently enabled. If paid plans are offered in the future, applicable pricing and any additional commercial terms will be presented before purchase.

These Terms may be updated from time to time. When they are, the effective date shown above will be revised.
